COX, Justice. These two actions of tort, tried together, were brought to recover damages caused by a fire, alleged to have originated on land belonging to one Roberts, from whom the defendant's board of public welfare on February 16, 1938, had purchased the right to cut and remove the standing timber and wood 'in such manner as it sees fit, and * * * retain this privilege and permission until the first day of April, 1939.' The trial Judge directed verdicts for the defendant, subject to the plaintiffs' exceptions.
